LINCOLN, Neb. (AP) — The Nebraska Court of Appeals rejected the appeal of a man serving life for the 1984 shooting death of his wife in Omaha.
David Harrison had filed a writ of habeas corpus, claiming he is being unlawfully imprisoned. Harrison said in claim that his trial judge improperly met with several jurors in his case before jury deliberations, which he said violated his right to due process and should have nullified his conviction and sentence.
A Douglas County court dismissed his claim, saying it didn't have jurisdiction because Harrison is imprisoned in Tecumseh in Johnson County.
On Tuesday, the state appeals court upheld the dismissal, but said the lower court should have dismissed Harrison's claim for improper venue, not lack of jurisdiction.
